Court Throws Out Bush Forest Management Regulations

SAN FRANCISCO, California, March 30, 2007 (ENS) -
The U.S. Forest Service can no longer use forest management regulations put in place by the Bush administration in 2005, because they violate three laws, a federal judge in California ruled today.

The ruling, by U.S. District Judge Phyllis Hamilton of the U.S. District Court for Northern California, invalidates regulations that changed the land management planning process for national forests by eliminating mandatory protections for wildlife and clean water and removing public participation in the process.

Among the measures discarded by the Bush administration was a key regulatory guarantee of wildlife viability in the national forests that had been in place since the Reagan administration.

"The national forest planning rules are like the Constitution for our National Forests, and the Bush administration tried to throw out the Bill of Rights," said attorney Trent Orr of Earthjustice, who argued the case before Judge Hamilton. "The Bush rule changes made any wildlife provisions in forest management plans purely aspirational, but the nation's wildlife deserve more than a 'hope and a prayer' planning system."

Earthjustice, representing Defenders of Wildlife, The Wilderness Society, the Sierra Club and Vermont Natural Resources Council, filed a legal challenge to the Bush administration rule changes in October 2004.

"The Bush administration¹s rules would have undone 20 years of protections for wildlife and clean water," said Sierra Club Forest Policy Specialist Sean Cosgrove. "This ruling is a huge victory for all Americans who hunt, fish, and enjoy our National Forests."

Judge Hamilton ruled that the Bush regulations violated the National Environmental Policy Act, the Endangered Species Act, and the Administrative Procedures Act.

"These regulations were designed by a former timber industry lobbyist," Cosgrove said. "They put the timber industry first and citizens and wildlife last. They would have silenced the voices of citizens in local forest planning, and allowed destructive projects to move forward with little oversight."

The judge's ruling prohibits the Bush administration from "implementation and utilization" of the new forest planning regulations. "The court verified what we already knew - that the Bush administration has used every angle possible to undo protections for our wildlife, forests, and clean water," said Cosgrove. "At a time when wildlife face mounting threats, we need to move towards responsible forest management that protects our public lands for future generations instead of giving them away to special interests."

SAN FRANCISCO, March 31, 2007‹As a precautionary measure, Del Monte Pet Products is voluntarily recalling select product codes of its pet treat products sold under the Jerky Treats®, Gravy Train® Beef Sticks and Pounce Meaty Morsels® brands as well as select dog snack and wet dog food products sold under private label brands. The Company took this voluntary recall action immediately after learning this morning from the FDA that wheat gluten supplied to Del Monte Pet Products from a specific manufacturing facility in China contained melamine. Melamine is a substance not approved for use in food. The FDA made this finding as part of its ongoing investigation into the recent pet food recall.

The adulteration occurred in a limited production quantity on select product codes of the brands below. This recall removes all Del Monte pet products with wheat gluten procured from this manufacturing facility from retail shelves.

No other Del Monte Pet Products treats, biscuits or wet dog food products are impacted by this recall,and no Del Monte dry cat food, dry dog food, wet cat food or pouched pet foods are subject to this voluntary recall. The affected products comprise less than one-tenth of one percent of Del Monte Pet Products' annual pet food and pet treat production.

Del Monte Pet Products has proactively engaged and fully cooperated with the FDA since the start of its investigation. The adulterated ingredients were used in limited production over the last three months for those items identified by specific product codes. Del Monte Pet Products has not used wheat gluten from this manufacturing facility in China in any other pet products except those described below.

At the end of this past February, Mao stopped eating. His vet told me he had
late stage kidney failure with off the chart readings. I made the decision
to have him put to sleep. I stayed up all night with him, took pictures, and
sobbed. He'd lay his head on my arm trying to comfort me... I found out a
couple of weeks ago about the recall. I fed Mao Iams Select Bites in Gravy
daily before his sudden death. I am livid. I'm going to speak out on this
issue as much as possible. I don't want Mao or the thousands of other
animals to have died in vain. Menu Foods does not deserve protection.

1. DO NOT FEED PET FOODS CONTAINING WHEAT GLUTEN.
(CNN, 4-1-07 - Unfortunately, Not an April Fool's Joke) I have purged my
pantry of all pet foods containing wheat gluten whether or not the producer
is on the recall list at this time. I have set these foods aside and have
NOT thrown them away or returned them, yet.
NOTE FROM KC: I know for a fact Wellness Brand uses NO WHEAT GLUTEN.

2. SAVE ALL receipts for ANY and ALL pet foods and bills for veterinary
visits, tests, medications, and your personal incidental expenses (including
but not limited to mileage to and from stores for different pet food, to
vets, to pharmacies, for physician visits and medication YOU require during
this stressful time, etc) in connection with any illness in your pet you
suspect or believe "may" be related to contaminated food -- whether or not
you intend to make a claim at this time.
(This language is intended to
ensure you leave nothing out!) Also, retain a portion of, or all of any pet
foods you have fed to your pets prior to this contamination recall,
particularly prior to an illness, including packaging, and receipts or
proofs of purchase for the foods. Remember, if at such time you decide a
claim is in order, too many documents and kinds of physical evidence are
better than none or not enough.

too - they confirmed they are about to do an official recall on dry food .
They said to quit feeding it to them immediately and go buy something not

Although some people were told of this pending recall from Nutro, others
were told that Nutro’s soon-to-be recall is not true... but here is my take
on it: The main thing I know is that my big dog, Zak, who was eating Nutro
dry (the others are on prescription food, thankfully!), was throwing up, as
well... with the yellow bile... blood in stool. So, I took a urine sample in
and was told that it tested strong for probable kidney failure, they would
have to take a blood test to be sure.  After the blood test, I was --
thankfully -- told that the kidneys were okay, but he did have a bladder
infection, and possible Cushing’s Disease.  Aside from that, I have had so
many of my cats die in the past couple of years from kidney failure and
unknown symptoms, and they were all on Nutro dry cat food...

I have heard so many people that have animals with similar symptoms with
Nutro dry, with blood in their urine, as well, testing strong for kidney
failure, coming out of it with with urinary infections, that I have to
believe something is dreadfully wrong with Nutro's food. I have now switched
to Blue holistic food for Zak (Royal Canin for my two remaining cats), and
he no longer vomits...no longer seeks out grass to eat... His stool is near
perfect and he's interested in food again. As a matter of interest, I will
also be calling the number, and asking for someone higher up to explain the
situation. But for me, talk is cheap... my dog is the proof of the matter,
and Nutro has way past betrayed my trust...

NOTE FROM KINSHIP CIRCLE: In light of last year’s Nutro “poison scare,” and
now the current recall, we advise everyone to steer clear of all Nutro products.

5. Some Retailers Not Pulling Recalled Food

Subject: Something YOU can do about the Menu Foods recall

PetSmart has an invested interest in taking the Menu Foods recalled food off
their shelves but supermarkets do NOT.

I was in a Giant supermarket today (March 26); in their "Reduced for Quick
Sale" bins I saw multiple cans of "Companion" cat food, all of which were
cuts, sliced and non-pate style canned food. I took the can to the general
manager and asked him if he was aware of the Menu Foods recall. He informed
me that the cans in the store were not on "the list," and that they had
removed the tainted cans, based on the UPC code, last week. I asked if he
was following the story and was he aware that Menu Foods had recalled ALL
cans, regardless of date code. He said, "well, yes, I saw something about
that this morning and I told my guy to look into it." He then went back to
what he was doing.

Go to your local grocery store or Walmart and check to see what is on the
shelves. If you find the poisoned food, remove it and take it to the general
manager and ask him/her to make it a priority to remove the food from the
shelves.

Assume that the average person a) doesn't know about the recall b) thinks
the quality food they buy at their local grocery store is "not on the list"
and help protect their pets for them! Also, the Washington Post did a story
several years ago about canned cat and dog food being purchased by poor and
homeless people as a cheap means of protein. You'd think the grocery stores
would be mindful of that sad fact even if they don't care about cats and

[From my friend on myspace] 3/22/07, Gayle writes: My brother has actually
been to the [MENU FOODS] plant in Columbia/Lexington, South Carolina. (He
automates machinery and they bought machinery from the company my brother
works for.) He said it was DEPPLORABLE! Upon entering the road to the plant,
there are barrels lined up, starting at the street. People from nearby areas
bring their dead pets, cattle, road kill and shelters (their euthanized
animals) and dump them in the barrels. The barrels are then taken inside the
plant where the carcasses are boiled. They pull out the larger bones to
resell as pet bones. The meat, hide, small bones and fur are ground up and
sold as pet food to the companies on the recall list. My brother said the
smell at that place is unbearable. He could not stay there because of the
smell and knowing how they made the pet food. He said he could not stop from
gagging... He said they also use rotten fish from the grocery store, old
dead chickens. After his trip to that plant, he began making his own dog
food for his dog

 ABOUT THE LABEL

What's really in that can of pet food on your shelf?
Here's a guide to some ingredients listed on the label and what they really are, according to the Association of American Feed Control Officials:

Chicken, beef or fish:
clean flesh from these animals.

Meat byproducts:
blood, bone and organs such as lungs, spleen, kidney, brains, liver, stomachs and intestines from slaughterhouses.

Poultry byproducts:
necks, feet, undeveloped eggs, lungs, intestines. Not feathers.

Meat or poultry byproduct meal:
blood, bone and organs that are rendered, dried and ground up. Can include tissue from animals that died outside slaughterhouses.

Steamed bone meal:
bones separated through cooking and ground up. It provides minerals, mainly calcium and phosphorus.

Taurine:
an amino acid needed by cats.

Grains:
labeled either as whole grains, such as corn or barley, or as ground milled products, which are what's left after flour and cereal are processed.

Vegetables:
dried yams, beet pulp, carrots.

Additives:
vitamins and minerals, flavorings and preservatives.

The Food and Drug Administration has received more than 4,400 calls from pet owners about the recalled, contaminated dog and cat food that has reportedly sickened and injured animals across the USA.

But the agency has yet to follow up on the calls, so it doesn't know how many represent sick animals or simply concerned owners, says Stephen Sundlof, director of FDA's Center for Veterinary Medicine.

Many pet owners are questioning the reported number of animals that have died from consuming contaminated pet food found in some of the more than 60 million recalled cans and pouches.

Menu Foods, which produced the food, has listed 16 deaths: 15 cats and one dog. The FDA is listing only 14 confirmed dead.

"That's such hogwash," says Jeff Burnton, 49, of Phoenix. He says his two dogs became sick on March 12 after eating kibble mixed with one of the recalled cans of food. Nikki was euthanized March 17; the other dog, Damion, just returned home from the vet on Sunday. "Not that they're covering up, but I think they're being corporate-like in what they're releasing."

An announcement Friday by authorities in New York state that their testing confirmed the presence of a rat poison, aminopterin, in samples of the recalled products explained some of the mystery.

While not legal for use in the USA, it is used overseas, officials at the Environmental Protection Agency say. The New York State Food Laboratory found the poison in the tested cat food samples. Dog food samples were not tested. Humans touching the food are not at any risk, officials say. Only eating the food is dangerous.

Aminopterin (am-in-OP-tah-rin) was originally used to inhibit the growth of tumor cells in the 1940s in the USA but was replaced with less toxic drugs later.

At high doses, aminopterin causes crystals to be created in the tiny tubes of the kidneys, plugging and damaging them and causing kidney failure, says Sandy Willis, a small-animal internist with the American College of Veterinary Internal Medicine.

ACVIM is recommending that veterinarians force fluids or use IVs to help flush the crystals out of the kidneys. But Willis cautions this is not something owners should try at home. Owners with sick pets should take them to a veterinarian, she says.

The Iowa State University Veterinary Diagnostic Laboratory and the Animal Health Diagnostic Center at Cornell University are collecting tissue samples from dead animals and kidney biopsies from living ones.

While some on the Web have wondered if aminopterin was in fact the culprit, a necropsy performed on Burnton's dog had exactly those characteristics. His dog's kidney tubules were destroyed by "abundant crystalline material," according to the veterinary pathologist who signed the postmortem report.

There are still questions about how many animals have died. With no national reporting system for animal injury or death, official numbers are impossible to come by.

However, data from the nation's largest chain of pet hospitals, Banfield, suggest it is as high as hundreds a week during the three months the food was on the market.

During that time, the more than 600 Banfield hospitals in 43 states saw 200 to 250 cases of kidney failure in cats above the usual number that would have been expected, says Hugh Lewis, president of Data Savant, Banfield's data collection arm.

During that period, Banfield vets saw 100,000 cats. Extrapolating to the entire cat population of the USA, that could mean "we're probably talking several hundred cats a week across the country being affected," Lewis says.

Another possible indicator is a database compiled by PetConnection.com. As of Sunday, owners reported 1,626 deceased pets ‹ 941 cats and 685 dogs, says Gina Spadafori, one of the website's writers.

She cautions that those figures were self-reported by pet owners and had not been confirmed by veterinarians. Menu Foods said on Friday it would compensate owners for their pets' medical bills.

"To the extent that we identify that the cause of any expenses incurred are related to the food, Menu will take responsibility for that," said Menu Foods chief executive Paul Henderson.

Despite some complaints by pet owners that animals have been sickened or died after eating dry food, FDA does not believe any dry food was involved in the contamination. Menu does not make dry pet food.

How the aminopterin got into the food is still an open question. FDA is looking into wheat gluten used in the food as "a likely suspect," but is "looking at each of the raw materials" in the food for contaminants, Sundlof says.

FDA has traced the wheat gluten shipments and says "the only place it has gone is into pet food," not the human food supply chain, Sundlof says.

While sabotage has not been ruled out, there are no leads in that direction, Sundlof says.

The entire incident merely underscores a need for more funding of the agencies that protect the U.S. food supply, says Jean Halloran, director of food policy initiatives for Consumers Union.

"The entire food-safety system is understaffed and underfunded," she says. Of particular concern is the FDA's inspection of imported food, she says.

Fisheries and Oceans Canada (DFO) makes every effort to ensure that seals are hunted as quickly, effectively, and humanely as possible.  Enforcement of the regulations is thorough and comprehensive, specifically ensuring adherence to catch requirements, licence conditions, and humane harvesting practices.  Penalties are tough and could include court-imposed fines, and/or orders to forfeit catches, gear, boats and licences.

The harp seal population is a healthy marine resource that can easily support a responsible harvest.  An abundance survey conducted in 2004 estimated the harp seal population at 5.82 million animals; approximately three times the population of less than two million in the 1970s.

Because the continued health and abundance of the herd is the department’s main priority, DFO sets quotas for harp seals to ensure that the resource remains sustainable.  Management measures have been developed for 2006-2010.  A number of conservation groups agree that a regulated and responsible harvest of the seal herd is appropriate, provided it is sustainable in the long-term from a conservation perspective.  As you may know, the hunt of harp (whitecoat) and hooded (blueback) seal pups has been banned in Canada since 1987.  Regulations also prohibit the trade, sale, or barter of the fur of these pups. 

The value of the seal hunt may appear negligible to some individuals, but it is tremendously valuable to those individuals who use it as their employment during a time when economic opportunities are limited in many remote, coastal communities.  Some sealers have stated that their income from sealing can represent up to 35% of their total annual income.  Also, the top homeports for sealers have unemployment rates that are in excess of 30% higher than the national average.  Sealing and fishing are also time-honoured traditions that allow people to provide for their families through knowledge of the marine environment and hard work. 

There are many measures in place to ensure a safe and humane harvest, such as close monitoring, tight regulations, and two-year apprenticeship training for those wishing to become professional sealers.  Harvesting methods used for the seal hunt have been studied and approved by the Royal Commission on Seals and Sealing.  The Commission found that the methods used in the harvest of the seal resource compare favourably to the use and dispatch of any other wild or domestic animal resource.  DFO also encourages the fullest possible commercial use of seals with the emphasis on leather, oil, handicrafts, and in recent years, meat for human and animal consumption. 

Veterinarians from the Canadian Veterinary Medical Association (CVMA) issued a Special Report on Animal Welfare and the Harp Seal Hunt in Atlantic Canada in September 2002.  Representatives and veterinarians of the CVMA made independent observations of the seal hunt.  The study concluded that a large majority of seals taken during the hunt (up to 98 per cent) are killed in an acceptably humane manner.  An Independent Veterinarians’ Working Group (IVWG) was formed in 2005 and made observations and recommendations to further improve management and hunting practices.  DFO is currently working to adopt these and other recommendations, such as improved enforcement and sealer training.

Attorneys for families who lost their pets to tainted dog and cat food amended a class-action lawsuit that was filed last week, claiming that the company involved may be trying to cover up what actually happened.

NBC5's Charlie Wojciechowski reported that the lawsuit was being amended on Wednesday in an effort to hold the companies involved more responsible. Attorneys said they believe the number of animals who died from eating the contaminated food were likely closer to more than 3,000 pets, not the 15 or 16 currently being reported by the Food and Drug Administration.

Nearly 100 store and major-brand pet foods were recalled by manufacturer Menu Foods Inc. on March 16. Three other companies have recalled some foods since then. Menu Foods officials were unavailable for comment, and its Web site was last updated March 16, Wojciechowski reported. Illinois Sen. Dick Durbin has scheduled an afternoon news conference on Thursday to announce that he would hold hearings on the pet food recall.

Attorneys said Menu Foods tried to cover up evidence of tainted food. Attorneys said Menu Foods first began hearing reports of sick pets in December of last year, but didn't begin testing animals until late February. On March 6, it found a new supplier of the now-suspect wheat gluten, attorneys said, but it took another 10 days to announce a recall.

"We think that it actually rises to the level of fraud," said attorney Jay Edelson.

22 Brands of Dog Biscuits Are
Added to Pet Food Recall

A recall of pet food tainted with melamine, a chemical used to make plastic products, has been widened to include 22 types of dog biscuits, the Food and Drug Administration <http://topics.nytimes.com/top/reference/timestopics/organizations/f/food_and_drug_administration/index.html?inline=nyt-org> said yesterday.

The biscuits, made by Sunshine Mills Inc., contain wheat gluten imported from China that contained melamine, said Stephen F. Sundlof, director of the Center for Veterinary Medicine at the F.D.A.

Sunshine Mills, of Red Bay, Ala., manufactures branded and private label dry pet food and biscuits. The recalled biscuits include Nurture Chicken and Rice Biscuit, Ol¹ Roy Peanut Butter Biscuit and Pet Life Large Biscuit.

Conrad Pitts, a lawyer for Sunshine Mills, said 80 percent of the tainted biscuits were sold by Wal-Mart, under the Ol¹ Roy brand. Mr. Pitts said that the company had produced about 24 truckloads of biscuits with the contaminated gluten, and that the majority of the product was large biscuits. He said wheat gluten accounted for less than 1 percent of the total weight of the biscuits.

Until last week, when moist cat treats, dog jerky and a type of dry cat food were added to the recall, it had been limited to wet pet food sold under a variety of brand names.

Menu Foods, which last month recalled more than 90 brands of its ³cuts and gravy² pet food, said yesterday that it had extended the period of time covered by its recall to include food made after Nov. 8, 2006. The company, based in Ontario, initially recalled only food made from Dec. 3, 2006, to March 6, 2007.

Menu Foods said it acted after a supplier, ChemNutra of Las Vegas, recalled all wheat gluten it had imported from the Xuzhou Anying Biologic Technology Development Company of Wangdien, China. ChemNutra said Wednesday that the F.D.A. had found melamine in the gluten. The agency said it was now testing all wheat gluten from China.

The Chinese government said yesterday that no wheat gluten had been exported to the United States or Canada. Xuzhou Anying denied it had ever shipped wheat gluten to either country.

³We are a trading company and don¹t manufacture the product,² added Mao Lijun, the company¹s general manager. Michael Rogers, director of the Division of Field Investigations for the F.D.A., said records showed that the tainted gluten came from China.

³We fully expect the Chinese government¹s cooperation and assistance in our further investigation,² Mr. Rogers said.

Mr. Rogers and Dr. Sundlof said the gluten did not enter the human food supply. The agency said that it was still investigating how the melamine got into the gluten, and that it had notified all companies that had received it.

Though melamine has been found in the food and in the urine and kidneys of pets that have eaten the food, officials and scientists are not sure whether the chemical actually caused pets to get sick.

Melamine, which is also used as a slow-release fertilizer, is generally not known to be toxic. Some theories are that it might act as a marker for another unknown toxin that causes renal failure in pets, Dr. Sundlof said, or that cats and dogs are extremely sensitive to melamine.

³We still have a lot of work to do to understand why melamine is involved, as it is a relatively nontoxic substance,² Dr. Sundlof said. ³We are relatively certain that there is a connection here someplace.²

The F.D.A. said it had received more than 12,000 complaints about pet food since the recall, as many as it usually gets in a two-year period on all topics combined. It has confirmed 16 deaths.

³We have no good information what that final number might be,² Dr. Sundlof said. ³It will take a while for us to get there.²

The College of Veterinary Medicine at Iowa State University <http://topics.nytimes.com/top/reference/timestopics/organizations/i/iowa_state_university/index.html?inline=nyt-org> is investigating 43 suspected cases of pets that died from eating tainted food; the deaths of 18 are consistent with ingestion of a toxin, said Patrick Halbur, executive director of the Veterinary Diagnostic Lab at Iowa State.

Dr. Halbur and Grant Maxie of the University of Guelph in Ontario, which is also investigating the cause of the illnesses and deaths, said it would probably take months to determine what made the pets sick.

In Chicago, Senator Richard J. Durbin, Democrat of Illinois, called for a hearing to question F.D.A. officials. He also called for standardized federal regulations and inspection requirements for pet food.

Around the country, animal advocates are giddy. Three food empires:
Smithfield Foods, the world's largest pork producer, Wolfgang Puck,
the world-famous chef/restaurateur/food-products creator, and Burger
King, the world's second-largest hamburger chain, have vowed to alter
their practices to reflect more humane standards of care for animals
used for food.  The veil is being lifted. Agribusiness has a hideous
face.

Smithfield's decision to phase out the "gestation crate" is certainly
a step towards more responsible stewardship over animals used for
food. ...

We can do far more to turn the tide, America, against an industry that
treats food animals as units of production in factories that "grow"
over 10 billion animals a year for us to eat.  We can reject factory
farming's barbaric practices by refusing to purchase
commercially-grown animal products. If we're really serious, we can
stop purchasing animal products altogether. Until we change what we
purchase, agribusiness will continue to torture animals, harm the
humans who eat them, and wreak environmental havoc.  If you need some
incentive, here it is:

1. The animals we eat are tortured from birth to death. The small farm
that once raised cows, pigs, and chickens humanely has virtually
disappeared from the American landscape.  ...

2.  Raising animals for human food is killing the planet.  Al Gore's
film An Inconvenient Truth brought conversations about global warming
into the mainstream. The climate is warming so quickly that, unless we
alter our lifestyles, weather patterns will be wildly unpredictable,

will soon be underwater.  Mystifyingly, Gore (presumably a meat eater)
omitted any discussion of a primary culprit in the warming of the

warming our planet than all transportation combined, and is destroying
the planet's biodiversity.  It is either the primary or a primary
contributor to air and water pollution, soil erosion, rainforest

less likely to develop cancer than meat eaters, and about ninety
percent less likely to have a heart attack. Strokes, many degenerative
diseases, and diabetes are all markedly lower in vegetarians than in
meat eaters. Vegetarians not only have lower cholesterol and blood
pressure, but not surprisingly, we're slimmer on average than our
carnivorous pals.

It is consumers, after all, who drive the market. Agribusiness will
change-rapidly-when our buying habits change. You are more powerful
than you think. Purchase with consciousness and compassion, and the
whole world will thank you.  Go to Burger King if you must...but buy a
salad.  Chances are that you're far hungrier for kindness than you are
for that burger.

and other information on animals rights issues. Becoming a member of both groups

for all.
