Thank you for your message. I appreciate you taking the time to share your
concerns with me.
The chapter of law governing dogs contains several provisions of law that
originated in the early 1900s dealing with dogs running at large and
injuring livestock or other domestic animals. Specifically, a dog owner who
is notified that his or her dog is found killing a domestic animal must kill
the dog within 48 hours of the notification. Failure to kill the dog is a
misdemeanor offense. Similarly, these old provisions also mandate that it
is a duty of the sheriff to kill any dog found running at large without a
metal identification tag, from the beginning of August through the end of
February.
SB 5870, and another bill, SB 5200, update these old laws by repealing the
outdated requirements to kill dogs that are on the loose. SB 5870 was added
on to SB 5200 and the bill passed through the Senate with a unanimous vote
on March 2nd. The bill is now being considered in the House of
Representatives.

MESSAGE:
I agree with staff's conclusion that the whole law needs to be removed not
just the misdemeanor part of if but also the sherrif's duties. I found it
interesting that staff didn't even know the law existed and the comments
that it was a hold over from previous time.
The ammendment now takes away the requirement that a dog must have killed
livestock and reads any dog w/o a metal take at large from August to April
must be shot!
Please ammend the bill to strike the entire law.
