I hope she has an excess liability policy. If she does, there is no question that she has liability coverage. Even if she doesn't, her homeowners insurance company should provide her with a defense, which is why we all pay for insurance. For those of you who don't have it, consider getting what is called an umbrella policy. It covers you for any coverage that you don't have specific insurance for. I have several excess liability (umbrella) policies that total $2,500,000. I got $1,000,000 for $40/year through my AERC membership (I have to be a member of AERC, which costs $65/year for a single, $15/year for
hubby). I also have one through my Farm Bureau insurance and one through my auto insurance company. I get $500,000 coverage from Farm Bureau for $94/year and my liability policy from AMICA (my auto company) is $286/year for $1,000,000. The main reason I got it 15 years ago was because of my horses. I had always heard horror stories about accidents just like this. Your beloved horse gets lose, someone hits it with their car and kills they horse and you get sued. I have always taken the approach that I want my insurance policies to be the most attractive thing to go after in a law suit, not my home or other assets.
This is terrible and it is even worse that she has to worry about being sued.
